This Public Offer Agreement ("Agreement") governs access to and use of AI Alpha Trader (the "Software"). By accessing, requesting access to, or using the Software, the User confirms full acceptance of this Agreement.
1. Nature of the Software
AI Alpha Trader is algorithmic execution software. It does not provide investment advice, does not manage accounts, does not accept, hold, or transfer funds, and has no access to user capital or credentials.
2. User Control & Responsibility
All trading activity is performed solely on the User’s own account. The User retains full control over their funds and assumes full responsibility for all trading decisions, configurations, and outcomes.
3. No Investment Advice
The Software does not provide financial, investment, or trading advice. Any information provided is for informational purposes only and shall not be relied upon as a basis for investment decisions.
4. Risk Acknowledgement & Assumption of Risk
The User acknowledges that algorithmic trading involves inherent risks, including the risk of financial loss. Past performance does not guarantee future results. By using the Software, the User voluntarily assumes all risks associated with its use.
5. Waiver of Claims
To the fullest extent permitted by law, the User irrevocably waives any claims, demands, or actions against the Provider related to trading losses, technical issues, market conditions, or use of the Software.
6. Dispute Resolution & Arbitration
Any disputes arising from this Agreement or the Software shall be resolved exclusively through confidential international arbitration. The User waives the right to participate in court proceedings or class actions, to the extent permitted by law.
7. No Reliance Statement
The User confirms that no guarantees, representations, or assurances regarding profitability or performance have been made and that no reliance has been placed on any statements or marketing materials.
8. Limitation of Liability
The Software is provided "as is" without warranties. The Provider shall not be liable for losses, damages, or consequences arising from use of the Software.
9. Governing Principles
This Agreement shall be governed by generally accepted principles of international commercial law. Users are responsible for compliance with local regulations.
Acceptance by Payment
By making any payment for access to AI Alpha Trader, including payments made in cryptocurrency or other digital assets, the User confirms full acceptance of this Public Offer Agreement and the Privacy Policy.
Any such payment constitutes unconditional agreement to all terms, conditions, limitations of liability, and risk disclosures set forth herein.
10. Final Acknowledgement
By using AI Alpha Trader, the User confirms understanding of the Software’s nature, accepts all risks, and agrees that the Provider bears no responsibility for trading outcomes.
